Definitions
In these Terms and Conditions, the following terms have the meanings given below:
- "Agreement" — these Terms and Conditions, together with any engagement letter or separate written agreement between you and the firm.
- "Firm" / "We" / "Us" — Warisan Advocate, a legal practice registered and operating in Malaysia, with offices at Block C, Level 3, Presint 3, Jalan P3, 62100 Putrajaya.
- "Services" — the pension legal services offered by the firm, as described on this website and in any engagement correspondence.
- "User" / "You" — any individual who accesses this website or submits an enquiry, and any person who engages us to provide Services.
- "Content" — all text, documents, data, and materials appearing on or made available through this website.
- "Engagement" — a formal instruction by a client to the firm to carry out legal work, confirmed in writing.
Section 02
Acceptance of Terms
By accessing and using this website, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in their current form.
Use of this website and the submission of an enquiry does not of itself create a solicitor-client relationship. That relationship arises only upon formal engagement confirmed in writing by the firm.
Our services are intended for adults. By using this website, you confirm that you are at least 18 years of age and have the legal capacity to enter into binding agreements.
Section 03
Services Described
Warisan Advocate offers legal advisory and preparation services in connection with Malaysian pension matters. The services currently available are:
- Initial Pension Consultation (WA-001) — a consultation with a qualified counsel, accompanied by a written note, at a fee of RM 480. This service does not constitute ongoing legal representation.
- Pension Calculation & Recalculation Request (WA-002) — preparation and submission of a formal recalculation request to the relevant authority, at a fee of RM 900. Timelines are subject to the authority's own processes, which may be slow.
- Survivor Pension Claim Preparation (WA-003) — preparation of a survivor pension claim on behalf of a spouse or dependant, at a fee of RM 1,500. Correspondence is handled at a pace suited to the family's circumstances.
The firm reserves the right to decline an enquiry or instruction at its discretion, without being required to give reasons.

User Responsibilities
When using this website, you agree to:
- Provide accurate, complete, and truthful information in any form or correspondence
- Use the website for lawful purposes only
- Refrain from attempting to gain unauthorised access to any part of the website or its underlying systems
- Not use the website in a manner that could impair, overburden, or compromise its security or availability
- Notify us promptly if you become aware of any inaccuracy in information you have previously provided
If you are corresponding on behalf of another person, you confirm that you have their authority to do so and that the information you provide about them is accurate and given with their knowledge.

Intellectual Property
All content on this website — including text, design, graphics, and the selection and arrangement of materials — is the property of Warisan Advocate or its content providers, and is protected under Malaysian intellectual property law.
You are granted a limited, non-exclusive licence to access and read this website for personal, non-commercial purposes. This licence does not extend to downloading, copying, reproducing, or adapting the content for any other purpose without our prior written consent.
Written notes and documents produced in the course of an engagement remain the property of the firm until fees have been settled in full.
Section 06
Fees & Payment
Service fees are as stated on this website and confirmed in writing at the point of engagement. All fees are quoted in Malaysian Ringgit (RM) and include applicable taxes unless stated otherwise.
Payment terms are set out in the engagement letter. Generally, fees for consultations are due prior to or at the time of the appointment. Fees for document preparation services may be structured in stages, as agreed.
Refund policy: For Initial Pension Consultations, a full refund is available if cancellation is made at least 24 hours before the scheduled appointment. For document preparation services, fees paid for work already undertaken are generally non-refundable. Each situation is considered on its merits and we will always try to reach a fair outcome.
The firm does not charge additional or hidden fees beyond what is disclosed at engagement. Disbursements (such as filing or postage fees charged by external authorities) may be passed on at cost, and will be identified separately.
Section 07
Service Terms
The scope of each service is as described in the engagement documentation. Any variation to the scope of work, or any additional work requested beyond what was agreed, will require a separate instruction and fee arrangement.
Timelines: We will provide realistic estimates of how long a matter is likely to take, but we do not make representations about the speed of decisions made by government departments or pension authorities. We will keep you informed of progress, including where matters are delayed through no action of our own.
Confidentiality: All information shared with us in connection with a matter is treated as confidential, subject to our professional obligations and any requirements of law. We do not disclose client information to third parties except as necessary to carry out the engaged work.
Document handling: Original documents entrusted to us are held with care and returned promptly once the matter concludes. We do not retain original documents for longer than necessary.

Whilst we take care in the conduct of our work, we do not represent or imply that any particular outcome will follow from engaging our services. Legal proceedings and administrative processes involve factors outside our control.
Section 09
Limitation of Liability
To the extent permitted by Malaysian law, the firm's liability in connection with any matter arising from the use of this website or the provision of services shall not exceed the fees paid in respect of the specific service to which the claim relates.
We shall not be liable for loss of income, loss of pension entitlements, or consequential or indirect losses arising from any delay, error, or omission by a third party, including any government authority or pension board.
Nothing in these Terms limits liability for fraud, wilful misconduct, or any liability that cannot be excluded under applicable law.
Section 10
Termination
Either party may bring an engagement to a close upon reasonable written notice. Where a client chooses to withdraw instructions, fees are due for work carried out up to the date of notice. We will provide a clear account of work completed.
The firm may, in exceptional circumstances, cease to act on a matter — for example, where a conflict of interest arises or professional obligations require it. In such cases, we will give notice as promptly as the circumstances allow and take reasonable steps to avoid prejudice to the client.
Provisions relating to intellectual property, confidentiality, fees already incurred, and limitation of liability shall survive the termination of any engagement.
Section 11
Dispute Resolution
These Terms are governed by and shall be construed in accordance with the laws of Malaysia. Any dispute arising out of or in connection with these Terms shall be subject to the jurisdiction of the courts of Malaysia.
Before initiating formal proceedings, we encourage any concerns or complaints to be raised with us directly. We will make a genuine effort to resolve any disagreement in a fair and timely way. Correspondence on complaints should be addressed to [email protected].
Clients engaged with the firm also have recourse to the Malaysian Bar Council's complaint procedures if a matter cannot be resolved directly between the parties.
Section 12
General Provisions
- Entire agreement: These Terms, together with any written engagement letter, constitute the entire agreement between you and the firm with respect to the subject matter, and supersede prior arrangements or understandings.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force.
- No waiver: Failure to enforce any provision at any time shall not be construed as a waiver of the right to enforce it subsequently.
- Assignment: You may not assign any rights or obligations under these Terms without our prior written consent. We may assign our rights to a successor practice.
- Notices: Formal notices under these Terms should be addressed in writing to the firm's registered office or to [email protected].
Section 13
Changes to Terms
We may revise these Terms from time to time. The revised version will be published on this page, with an updated date. Changes do not affect engagements already in progress, which continue to be governed by the terms in place at the time of engagement unless both parties agree otherwise in writing.
Continued use of this website after a change is published constitutes acceptance of the revised Terms.
